Please read these terms carefully before using MyColorPass

By creating an account, subscribing, or using MyColorPass, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the app.
These Terms constitute a legally binding agreement between you and Chroma Lab Digital OPC (“we”, “us”, “our”), a One Person Corporation registered in the Philippines. Our registered address is Bonifacio Global City, Taguig City, Metro Manila, Philippines.
MyColorPass is a personal color analysis companion app that provides:
The app is available via web browser at mycolorpass.app and as a native mobile application where available.
You must be at least 18 years old to create an account and subscribe. By using MyColorPass, you confirm that you are 18 or older and have the legal capacity to enter into this agreement.
You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at admin@mycolorpass.com if you suspect unauthorised access to your account. We are not liable for losses resulting from unauthorised use of your account due to your failure to keep credentials secure.
You may not create more than one account per person. Accounts are non-transferable.

There is no Monthly Pass in the Philippines.
The Founder rate is a lower Annual Pass price for the first 100 Annual Passes sold in each region: 100 in the Philippines and 100 internationally. Once you have it, you keep it for as long as you keep subscribing.
Verified Color Analysis Studio PH clients who buy an Annual Pass on or before the last day of their free month (see Section 5.5) get the Founder rate even if all 100 places in their region have been taken. After that day, studio clients can still get the Founder rate while places remain, like any other member.
The Founder rate applies to Annual Passes only. Monthly Passes are not eligible and do not use a Founder place.
If a Founder subscription is refunded, or ends without being renewed, the Founder rate is forfeited. Buying again later is at the then-current price.
Verified Color Analysis Studio PH clients get 30 days of free MyColorPass access. The 30 days start the first time you sign in to MyColorPass, not on the date of your studio session or the date your account was created.
No payment method is needed and nothing is charged. When the 30 days end, your account returns to the free tier unless you buy a Pass. Nothing converts to a paid plan automatically.
To keep the Founder rate guarantee in Section 5.4, buy an Annual Pass on or before day 31. The app shows the exact date on your membership card.
If your free month ended before 21 September 2026, you have 7 days from the first time you see the notice in the app, and the Founder rate guarantee lasts until the end of those 7 days.
The free month is available once per verified studio client. It is non-transferable and may not be combined with any other promotional offer.
Philippine members are billed via PayMongo. International subscribers are billed via Paddle.
PHILIPPINE PASSES DO NOT RENEW AUTOMATICALLY. WE DO NOT STORE YOUR CARD AND WE CANNOT CHARGE YOU AGAIN WITHOUT YOU BUYING ANOTHER PASS.
An Annual Pass bought in the Philippines is a single payment covering 12 months from the date of purchase. Card, GCash and Maya all work this way. When the 12 months end, your access returns to the free tier until you buy another pass.
We will email you before your pass runs out so it does not lapse without warning. There is nothing to cancel, because nothing recurs.
INTERNATIONAL SUBSCRIPTIONS AUTOMATICALLY RENEW AT THE END OF EACH BILLING CYCLE UNLESS YOU CANCEL BEFORE THE RENEWAL DATE.
By providing a payment method for an international subscription, you authorise us to charge the applicable fee at the start of each billing cycle.
For monthly subscriptions: your subscription renews every 30 days.
For annual subscriptions: your subscription renews every 12 months.
We will send a renewal reminder email at least 30 days before your annual subscription renews, and at least 7 days before your monthly subscription renews. The reminder will state the amount to be charged, the renewal date, and how to cancel.
For standard subscribers, we may change subscription pricing with at least 30 days written notice by email. If you do not cancel before the new pricing takes effect, you consent to the new rate.
For Founding Member subscribers, your locked rate will not increase for as long as your subscription remains active and in good standing.
If a payment fails, we will retry the charge up to three times over a 7-day period. If payment cannot be collected, your subscription will be suspended and you will be notified by email. Access to premium features will be paused until payment is resolved.
You may cancel your subscription at any time through:
Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the period ends. We do not offer pro-rata refunds for unused portions of a billing period except where required by law.
Cancellations must be made before the renewal date to avoid being charged for the next period. If you cancel after a charge has been processed, see our Refund Policy for eligibility.

Promotional codes (including studio-client codes) are subject to the following terms:
Studio-client promotional codes are reserved for verified past clients of Color Analysis Studio PH. Use of these codes by ineligible parties constitutes a breach of these Terms and may result in account suspension.
All content within MyColorPass including but not limited to the KCI color methodology, Munsell-based analysis engine, app design, copy, artwork, and branding is owned by or licensed to Chroma Lab Digital OPC.
You may not copy, reproduce, distribute, modify, or create derivative works from any MyColorPass content without our prior written permission.
Your personal data, wardrobe entries, and content you create within the app remain yours. By using MyColorPass, you grant us a limited license to store and process that content to provide the service.

We reserve the right to suspend or terminate accounts that violate these terms.
MyColorPass provides color analysis guidance for personal styling purposes. It is not a substitute for professional image consulting, medical advice, or any other regulated professional service.
Color rendering on screen depends on your device display calibration. We cannot guarantee color accuracy on all devices. The Munsell-based analysis engine uses approximations and is not physically calibrated to the official Munsell renotation dataset.
The service is provided “as is” without warranties of any kind, express or implied, to the fullest extent permitted by applicable law.
To the fullest extent permitted by Philippine law and applicable international law, Chroma Lab Digital OPC shall not be liable for:
Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from these Terms or your use of MyColorPass shall be subject to the exclusive jurisdiction of the courts of Taguig City, Metro Manila, Philippines.
Before initiating any formal dispute, you agree to contact us at admin@mycolorpass.com and allow 30 days for us to attempt resolution in good faith.
For international subscribers, where mandatory consumer protection laws in your jurisdiction provide additional rights, those rights are not affected by this governing law clause.
In compliance with the Philippine Internet Transactions Act of 2023 (RA 11967):
We may update these Terms from time to time. Material changes will be communicated by email at least 30 days before they take effect. Continued use of MyColorPass after the effective date constitutes acceptance of the updated Terms.
